Terms of Service

The terms that govern your use of pc-cn.com and any commercial relationship with The Power Contractor.

1. Use of this site

This website is for the use of industrial buyers and procurement professionals seeking information about industrial equipment and EPC services. By using the site, you agree to these terms.

2. Quotations & orders

All written quotations are valid for 30 days from issue date unless otherwise stated.

Orders are placed only once a written purchase order or signed proforma invoice is received and acknowledged.

Payment terms vary by order — letter of credit (LC), telegraphic transfer (TT) or wire are standard. Specific terms are stated on each quotation.

Title to goods passes on full payment. Risk passes on the Incoterm® stated on the proforma (typically FOB or CIF).

3. Authenticity & warranty

We supply new, genuine OEM equipment only. We do not deal in refurbished, second-hand, counterfeit or grey-market parts.

Manufacturer's standard warranty applies to all goods on the terms set by the original manufacturer. We facilitate warranty claims at no additional charge.

We do not extend, modify or replace any manufacturer warranty unless expressly stated in writing on the relevant quotation or contract.

4. EPC engagements

Engineering, procurement and construction engagements are governed by a separate signed contract that supplements (and where conflicting, supersedes) these site terms.

5. Trademarks & IP

All third-party trademarks, product names, model numbers and part numbers referenced on this site are the property of their respective owners and used under the doctrine of nominative fair use to identify equipment. The Power Contractor is an independent supplier and is not affiliated with, endorsed by, or authorized by any such manufacturer.

6. Limitation of liability

To the maximum extent permitted by applicable law, The Power Contractor's aggregate liability arising out of or in connection with any supply contract is limited to the amount actually paid by the buyer under that contract.

In no event shall we be liable for any indirect, consequential, special, incidental, or punitive damages, including loss of production, loss of profit, or business interruption.

7. Export compliance

You agree to comply with all applicable export control laws and regulations of China, the United States, the European Union, and your local jurisdiction. We will not knowingly supply equipment to sanctioned parties or to end-uses prohibited by applicable law.

8. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control: acts of god, war, civil unrest, government action, pandemic, port closures, or carrier failure.

9. Governing law & dispute resolution

Unless otherwise agreed in writing, these terms and any supply contract are governed by the laws of the People's Republic of China. Disputes are subject to arbitration in Shanghai under the SIAC or CIETAC rules, with arbitration in English.

10. Changes

We may update these terms at any time. The current version is the version posted on this page.
